Terms & Conditions

 

For short-term or long-term projects as agreed by both parties:

• The contractor ( Troy Murphy ) will render services based on agreed specifications and using written content and photographs from the client, AND Sourcing, proofreading, creating/writing content and images (eg. for detailed areas of the project that may be overlooked by the client when supplying the main content) for anything deemed necessary/appropriate by the contractor.  Even if the client rejects the proposed content, the contractor reserves the right to include the time for its creation/sourcing in charged time, AND Any time spent communicating about the above (eg. writing emails, on the phone etc.).

• To be completed within agreed timeframes or as is reasonable for each project.

• To be ongoing unless the contract is updated or withdrawn or if both client and contractor communicate and agree to terminate a project or arrangement.

 

The client agrees to supply to the contractor:

• The agreed rate / fixed price ( eg. AUD $65.00 per hour or part thereof ) to be directly transferred to the contractor’s bank account by the due date given on each invoice (payment terms usually 14 working days).

 

The contractor agrees to supply to the client:

• Regular updates on the contractor’s progress and the opportunity for the client to comment and make changes to the working plans, designs, web pages etc. unless the contractor is waiting for the client to supply copy, images, changes etc.

• An invoice including a rough breakdown of time spent and amounts charged (or an invoice and time sheet).

• After payment in full is received: important working files, usernames and passwords if requested.

 

The contractor further agrees that

• During any phase of the work, the contractor will consult the client before making major changes, however reserves the right to make minor changes at any time without consulting or notifying the client.

• Any sensitive information or company or personal user names and passwords supplied by the client will remain confidential.

• The contractor is liable to pay for its own overheads: eg. communications, travel, materials, hardware, software and internet expenses.

• The copyright for the work remains with the client and/or the original copyright owner of the content.  The copyright for any original graphics or write-ups done by the contractor during charged time to the client is assigned to the client, however the client grants to the contractor an ongoing right to utilise final work samples in its own promotional material, in any medium, in a free or commercial aspect. Any works completed in the contractor’s own time (eg. this contract) remains the property of the contractor.

• The contractor will attempt to adhere to the copyright laws of Australia and any other relevant countries, taking steps to keep records of the sources (and permissions for the use) of any other creative property for the work.  The contractor will also credit the copyright owners of the other creative property if required.  If possible, the contractor will avoid using any other creative property that costs money and/or requires written credits.

• Communication will be made through email or phone conversation. Text message and social media are asked not to be used, usless otherwise agreed upon.

• The client acknowledges and concurs with the above terms also.

 

The client further agrees that:

• The contractor shall not be held liable for anything relating to the content or production of the project or work.

• Any sensitive information or company or personal user names and passwords supplied by the contractor will remain confidential.

• The client is responsible for the payment of bills to the publisher/producer of the project (eg. web-host, printer, DVD producer).

• It will not engage any other new contractors or businesses that compete with Troy Murpht Dot Nets’ primary services (existing or in-progress arrangements are excluded) except after consultation. Troy Murpht Dot Nets’ primary services are graphic design for print and web, social media marketing, email newsletter design, copywriting and editing.

• By initiating the job request the contractor acknowledges and concurs with the above terms also.
